U.S. State Privacy Law Notice

Learn about your privacy rights and choices under applicable U.S. state privacy laws.

Effective Date: September 18, 2026

This U.S. State Privacy Law Notice (“Notice”) supplements the information contained in Protech’s Privacy Policy. Depending on where you reside, you may have certain rights and choices regarding our processing of your Personal Information. This Notice applies to residents of states with comprehensive data privacy laws (for example, Delaware, California, and Texas) regardless of the applicability of particular state laws to Protech and notwithstanding the fact that certain state laws may, in fact, not be applicable. We reserve the right to discontinue this policy on a going forward basis, and to limit the rights described in this section to only residents of states with applicable data privacy laws. In addition, notwithstanding the above, with respect to job applicants, this Notice only applies to residents of states which extend their comprehensive data privacy laws to individuals acting in an employment context (for example, California).

We reserve the right to modify, expand, or update this Notice at any time as we deem appropriate to reflect changes to this Notice. When we make changes to this Notice, we will post the updated Notice on the website and update the Notice’s “Effective Date” above. It is important that you check back from time to time and make sure that you have reviewed the most current version of this Notice. This Notice is not a contract and does not create any contractual rights or obligations.

Your Rights and Choices

Right to Know. You have the right to confirm whether we collect Personal Information about your and request that we disclose certain information to you about our collection and use of your Personal Information. Once we receive and verify your request, we will disclose to you:  

  • Categories of Personal Information we collect about you.
  • Categories of sources from which the Personal Information is collected.
  • Business or commercial purposes for collecting, sharing, selling, and disclosing Personal Information.
  • Categories of third parties with whom we disclose or share Personal Information.
  • Specific pieces of Personal Information we have collected about you.

Data portability. You have the right to request that we transfer the Personal Information we have collected about you to another organization, or directly to you, in a structured, commonly used, and machine-readable format, subject to conditions under applicable law.

Deletion. You have the right to request that we delete your Personal Information that we collected from you and retained, subject to certain exceptions under applicable law, including but not limited to where retention is necessary to complete a transaction you requested, fulfill the terms of our written warranty, or in the context of our ongoing business relationship with you.

We may maintain a confidential record of deletion requests, for compliance with applicable law, or for other purposes permitted under the applicable law.

Correction. You may at any time direct us to correct any inaccuracies in the Personal Information that we maintain about you. Depending on the purpose of the processing, you also have the right to request that we complete the Personal Information we hold about you where you believe it is incomplete, including by means of providing a supplementary statement.

We may decline to correct the Personal Information if we determine based on the totality of the circumstances that the Personal Information we have on file is more likely than not accurate, or if we determine the request is likely fraudulent or abusive.

If we decline to correct the Personal Information, you may request that we note in our records and notify any service providers and other third parties to whom we disclosed the allegedly erroneous information that its accuracy has been disputed.    

Restrict Use or Disclosure/Sharing of Personal Information for Advertising & Marketing and Sale of Personal Information (an “opt-out request”). We disclose and share, and have disclosed or shared within the last twelve (12) months, Personal Information, specifically identifiers and internet or similar network activity, to our affiliates and third-party advertising and marketing providers.

Such disclosures may also constitute a sale of personal information under applicable data privacy law.

You have the right, at any time, to request that we not sell your Personal Information or use, disclose, or share your Personal Information for advertising and marketing purposes, including but not limited to targeted and cross-context behavioral advertising.

Do Not Track (“DNT”) is a privacy preference that visitors can set in their web browsers. There is no industry consensus for how to recognize DNT signals – for that reason, we do not respond to DNT signals.

We do not have actual knowledge of selling or sharing the Personal Information of consumers under the age of 16.

Opt out of profiling in furtherance of a decision that produces a legal or similarly significant effect on you. You have the right to opt out of the processing of your Personal Information for purposes of profiling in furtherance of a decision that produces a legal or similarly significant effect on you. This includes the right to opt out of automated decision making or artificial intelligence in a way that may be limited under applicable law.

Sensitive Personal Information.  Our use of Sensitive Personal Information, which includes credit card information and protected classification characteristics, is limited to performing the services or providing the goods reasonably expected by you. We do not disclose or use Sensitive Personal Information for purposes which can be limited under California law. If we begin to use or disclose Sensitive Personal Information for a purpose which can be limited, we will provide you with that right.

How to Exercise Rights & Choices

To exercise the access, data portability, correction, deletion and profiling rights described above (a “verifiable request”), please submit a verifiable consumer request to us either by:

In certain jurisdictions, a person authorized to act on your behalf may make a verifiable consumer request related to your Personal Information. If you designate an authorized person to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent with such permission.

Only you, or a person legally authorized to act on your behalf, may make a verifiable request related to your Personal Information. You may also make a verifiable request on behalf of your minor child.

Your verifiable request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. Our verification procedures may differ depending on the sensitivity of the Personal Information, and the risk of harm to you by unauthorized disclosure or deletion as applicable. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. We cannot respond to your verifiable request or provide you with Personal Information if we cannot verify your identify or authority to make the request and confirm the requested Personal Information relates to you.

We will acknowledge receipt of and respond to your verifiable request in the timeframe required by appliable law.

If we deny your verifiable request, you have the right to appeal the denial within the time frame specified under applicable law. You may submit an appeal by contacting us via mail or email at the addresses provided at the end of this Notice (see “Contact Us”). If your right to appeal is denied, you may contact the Attorney General in your state.

Opt-out requests are not subject to the above noted verification measures. Opt-out requests may be submitted through the above noted methods or through a browser-based opt-out preference signal. We will comply with such requests in the time frame required by applicable law.

Please note that many of the rights listed herein are subject to exceptions and limitations and our responses may vary based on your specific state of residency.

Non-Discrimination. We will not discriminate against you for exercising any of your rights under applicable state privacy law, including as a job applicant or employee. We will not deny you goods or services, charge you different rates for goods or services, provide you with a different level or quality of goods or services, or suggest that you may receive a different rate for goods or services or a different level or quality of goods or services.

However, we may require the use of your Personal Information to provide access to our services. Therefore, when you exercise your deletion right, in particular, as well as other rights, you may lose access to certain aspects of the services that require your Personal Information.
